According to SILive.com, a Willowbrook woman who allegedly received bad breast implants is suing a plastic surgeon for a breast deformity that developed after her breast implant surgery.
Maria Alaimo, 47, went to Dr. Berman seven years ago to receive a breast enhancement of 36 C cups. However after the surgery, Ms. Alaimo developed "double-bubble" deformities. Her New York injury lawyer told the court on Monday that, "Maria came out of that operation with essentially four breasts."
Her lawsuit details that this deformity caused her "pain... disability, loss of self-esteem, humiliation and embarrassment" in addition to a divorce from her husband. Her case concerning medical malpractice and negligence is being heard at the state Supreme Court in St. George. She is seeking $5 million dollars in damages from Dr. Berman. In addition, his staff and two internet companies that referred the doctor are included as defendants: My Choice Medical Inc. and 1-800-Be-Your-Best. My Medical Choice had Dr. Berman on their list of "the best doctors." They also received a referral fee after the victim committed to the surgery.
Ms. Alaimo's New York injury lawyer claims that after the first failed attempt in March of 2003, Dr. Berman offered to perform a corrective surgery. The second surgery in July of 2003 was allegedly no better. Instead of seeing Dr. Berman for a third time, My Medical Choice paid to have her surgery performed by a different doctor. Unfortunately, that surgery produced even more scars.
The victim alleges that in the same year as her third corrective surgery, she and her husband divorced, according to the Village Voice. She claims that she "never allowed her husband to see her undressed again" because of the scars and the deformities.
SILive.com reports that after the victim arrived 20-minutes late to her first surgery, she claims that she signed a 12-page disclaimer while she was being rushed into pre-op. Also, even though Dr. Berman claimed to have marked the surgical areas on Ms. Alaimo's breasts with elliptical lines, the victim's New York injury lawyer produced a photo that showed no markings just before the surgery began.
